As Council is aware, DOT will unfortunately not review Functional Layout Plans until such time as a planning permit is in place and is the main driver for making this application. We consider that the process is somewhat reversed due to DOT’s policy and therefore suggest that flexibility is included with any subdivision permit issued so that Council can have comfort that the FLP and POS will be consistent. We therefore would suggest inclusion of a condition in the permit that states “prior to a Statement of Compliance the plan of subdivision must be in accordance with the associated Functional layout Plan approved by the Department of Transport to the satisfaction of Council”. We further note that recent experience with Ausnet networks (Gas) suggests they will not allow gas relocations to occur before the subject land is registered as road reserve. Given gas relocations are the first item required for the construction of Francis Street the subject land will be required to be vested as road reserve before any works commence on the relevant section of Francis street. It will be necessary for Council and DOT consider the necessary permit conditions to allow the subject land to be vested as road prior to works commencing. Planning Permit
